By accessing or using the Tails Beyond Borders Foundation (“TBBF,” “we,” “our”) website or participating in our campaigns, you agree to the following Terms of Service. Please read them carefully.

Donations, Sponsorships & Online Engagement

When you donate to TBBF:

• Your donation is handled through secure, U.S.-based nonprofit systems.

• All funds are tracked, receipted, and used for mission-related purposes.

• Sponsorships and symbolic recognitions are non-refundable and are intended to build connection, not imply ownership rights.

• Many employers offer donation matching; check with your HR department to double your impact.

Tails Beyond Borders Foundation is a U.S.-registered 501(c)(3) nonprofit. Our EIN is 39-3041061. Donations are tax-deductible under U.S. law to the extent allowed by law. Donation receipts are issued electronically for tax reporting purposes.

All gifts in the Virtual Gift Shop are symbolic representations of charitable support. No tangible goods or services are provided in exchange for these donations. Donations go directly to animal care, and no products will be shipped. Contributions, including virtual gifts, are tax-deductible to the extent allowed by law.

In-Kind Donations & Creative Works

Tails Beyond Borders Foundation gratefully accepts in-kind donations, including artwork, embroidery, crochet, photography, paintings, handmade jewelry, crafts, decorative items, and other creative works.

Upon acceptance, ownership of donated items transfers to Tails Beyond Borders Foundation. Accepted items may be sold, auctioned, displayed, photographed, promoted, stored, combined with fundraising activities, or otherwise used in support of the Foundation's charitable mission.

Contributors must own the rights to the items they donate. Tails Beyond Borders Foundation reserves the right to accept or decline any donation at its sole discretion.

Donated items generally cannot be returned after acceptance. The Foundation does not guarantee that any donated item will be sold, displayed, promoted, auctioned, or used in any particular manner.

No compensation, reimbursement, tax benefit beyond any applicable charitable deduction, or future consideration is provided in exchange for donated items unless expressly stated in writing by the Foundation.

Artwork Sales, Handmade Items & Portrait Commissions

Tails Beyond Borders Foundation may offer donated artwork, handmade jewelry, crafts, decorative items, handmade goods, and custom portrait commissions as part of its fundraising activities. Purchasers acknowledge that donated and handmade items are unique and may differ from photographs, descriptions, or expectations due to their handmade nature.

Because purchasers may receive goods, services, artwork, handmade items, custom commissions, or other items of value in exchange for payment, all or part of the purchase price may not be tax-deductible. Tax treatment varies depending on the transaction and applicable law. Tails Beyond Borders Foundation does not provide tax advice. Purchasers should consult their tax advisor regarding their individual circumstances.

Unless otherwise stated, artwork, handmade items, jewelry, crafts, decorative items, and creative works are provided on an "as-is" basis. To the fullest extent permitted by law, Tails Beyond Borders Foundation disclaims all warranties, express or implied, including warranties regarding condition, durability, merchantability, fitness for a particular purpose, authenticity, or future value.

Handmade items may vary in appearance, materials, size, color, finish, and craftsmanship, and minor variations or imperfections are inherent characteristics of handmade goods.

Custom portrait commissions are artistic interpretations created from photographs provided by the purchaser and are not exact reproductions. Estimated completion times are provided for planning purposes only and are not guaranteed.

Custom portrait commissions are generally non-refundable once work has begun. Tails Beyond Borders Foundation reserves the right to decline or cancel any commission prior to commencement of work.

Tails Beyond Borders Foundation shall not be liable for dissatisfaction arising from artistic style, minor variations from submitted photographs, ordinary wear, shipping delays outside its control, or circumstances beyond its reasonable control.

By purchasing a portrait commission, the purchaser acknowledges that artistic style, composition, and interpretation are subjective and may vary from expectations.

In the event of a pricing, description, availability, or technical error, Tails Beyond Borders Foundation reserves the right to correct the error and to cancel, refuse, or modify orders placed based on inaccurate information.

Tails Beyond Borders Foundation reserves the right to modify, substitute, discontinue, decline, limit, or cancel any product, commission, donation-based item, or fundraising offering at any time and for any reason, including inventory limitations, pricing errors, donation availability, or operational considerations.

Product photographs, descriptions, and dimensions are intended to represent items as accurately as possible. However, colors, brightness, scale, measurements, and appearance may vary due to photography, lighting conditions, screen settings, individual device displays, and the handmade nature of certain items.

Shipping

Shipping dates and delivery estimates are provided for convenience only and are not guaranteed.

Tails Beyond Borders Foundation is not responsible for delays caused by shipping carriers, weather events, customs processing, incorrect addresses provided by purchasers, or circumstances beyond the Foundation's reasonable control.

Purchasers are responsible for providing accurate shipping information at the time of purchase. Risk of loss and title pass to the purchaser upon confirmed delivery by the shipping carrier, where permitted by applicable law.

Tails Beyond Borders Foundation shall not be responsible for delays, interruptions, or failure to fulfill obligations resulting from events beyond its reasonable control, including natural disasters, severe weather, fires, floods, pandemics, labor disruptions, internet or technology failures, governmental actions, supply chain disruptions, shipping interruptions, or other unforeseen circumstances.

Refund Policy

Donations are voluntary charitable contributions and are generally non-refundable. However, TBBF will review and correct documented processing errors or duplicate charges upon written request within a reasonable time. Except as otherwise stated, custom artwork, portrait commissions, handmade items, and fundraising merchandise are generally non-refundable once production, fulfillment, or shipment has begun.

Use of Our Website

By using our site or participating in our campaigns, you agree to:

Sanctions and Compliance

Tails Beyond Borders Foundation operates in compliance with applicable United States laws and regulations, including those administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC). Nothing on this website shall be interpreted as encouraging, authorizing, or facilitating any activity that would violate applicable sanctions, export controls, or other legal requirements.

Limitation of Liability

TBBF strives to provide accurate and reliable information; however, we make no representations or warranties regarding the completeness, accuracy, or reliability of content on this site. Use of the website is at your own risk. TBBF shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of this site, reliance on its content, or third-party links. Nothing in these Terms shall limit liability where such limitation is prohibited by law.

To the fullest extent permitted by law, Tails Beyond Borders Foundation's total liability arising from any purchase, donation, commission, use of the website, or participation in Foundation activities shall not exceed the amount paid directly to the Foundation in connection with the specific transaction giving rise to the claim.
